Reference to the above mentioned subject, we would like highlight some important points,
First of all the drawing (BAW-ONC—P018-A) as per submittal ONC-RFA-#2 M-356-B is only for sewer, then the Mechanical Engineer told us to show

As discussed with the concerned Engineer we told him, that we will submit a separate drawing showing full details of the pumps with corresponding elevation including

We are builder not designer so please we need your design to implement it on site. This is also applicable to your requirement of all.

Since you change the original design of, you have to re-design it and we will submit construction drawing based on your design.
Our projects is delayed due to this yo-yo comments from Engineer, from now on we want to received only technical comments on our submittal especially from your Mechanical Engineer so that we can response quickly to any technical comments and it will avoid more delayed on our projects.
He always makes comment “FOLLOW CONTRACT DOCUMENTS & STANDARDS” which is very broad, what we want is technical comments so that we can understand him better.
We want to finish this project on time and if you will not help us in resolving problem which are not created by us we cannot finish this project because what is happening now is we move two step forward but the comments from your Engineer is making us three step backward.
Our submittal for mechanical discipline are release after two weeks or less, we want to received the submittal as soon as possible approved or disapproved so that we can take necessary action what ever is required.
We are suffering enough for this project; we want to finish it, so that we can move our life to another challenge somewhere.

Method of Statement for Excavation

Proposed Method of Statement for Excavation of the Building
1. Set out the location area as per the coordination drawing, or as per existing building because in
relation of tie in.
2. Secured the area, by erecting temporary fence around the site, as approved by the Engineer.
3. Request for site inspection, prior to start of excavation.
4. K.A.M.C. to relocate all existing underground facilities which will be affected during excavation.
5. Excavation will be executed by any of the following methods:
A. Manual excavation on sensitive areas.
B. Jackhammer for medium areas.
C. Excavator for normal area & rock area.
6. Excavation limit will be 1500 mm. away from the edge of the footing or to a minimum distance
away from any structure or any underground services
7. Vertical excavation will be done on rock formation & 2:1 slope on unstable soil.
8. A permanent spotter will be assigned during excavation to ensure that all required depth will be followed.
9. Disposal of unsuitable materials shall be in areas specified by the concerned local authority w/
the approval of the Engineer.
10. Classified materials to be stored on approved location by the Engineer for the future use.
11. Wheel loader will be used for loading all excavated materials to a dump truck.
12. The loaded materials will be properly covered before leaving the jobsite.
13. Prior leaving the job site all heavy equipment should be clean to avoid spreading dirt on the
existing roads.
14. Adequate dewatering on site is to be done, if encounter to prevent natural ground water from
flowing to excavated areas.
15. Install temporary barriers with ropes, warning tape, & corresponding signage +_ 2 Meters from
the edge of excavation.
16. Notify the Engineer of a sign of failure for cracks within or around the excavation, immediately
when such sign are noticed.
17. Trenches to be excavated to uniform widths to provide a working clearance on each side of pipe or
conduit.
18. At the end of any working day secured the area by closing all point of exit & entry to ensure safety.

WORK PROGRESS Excavation activity has been obstructed
As you are aware that mobilization, temporary facility and perimeter fence has been started directly after we received the (Site hand over notice) on the 7 of June 2006, in Parallel with hand execution to clarify any under ground facilities.
Excavation activity has been obstructed by the buried under ground facilities
(Cables, fire fighting pipes, etc.) Observed at site location, subsequently our Permission Request for excavation submitted on 27 June 2006, work has not release by your office and work progress is obstructed due to removing & re-routing of the existing utilities by other parties.
Therefore, for the required permission, we remain and in the same time, we would like to reserve our right for the time extension equivalent to this cumulative delay.
Hope we inform you accordingly.

We want also to remove all the loose excavated materials so that we can check if the initial excavation depth will pass for the bearing test, but this water line is crossing the building plot on both directions.
This water line is also hampering our production on site, because we are not working continuously on one place, we are jumping from one place to another just to avoid damaging this water line.

We are facing financial difficulty because we are spending too much on the project but we can only claim what is actual done on site even though most of our materials are on site.

Subject: EVALUATION,
We are suffering for claiming our rights on the completed items and delivered materials on site due to the fact that we don’t have any basis or system of collection how we can claim a certain percentage base on our approved B.O.Q.
As of this moment, it is an almost never ending negotiation to each item between our Engineers and the client Engineers. We are trying our very best how to avoid this problem in the future by having a system of collection but I think it will be much more better if this problem will be arranged at the N.G.H.A. in Riyadh.
We are also having difficulties how to claim all items that exceed the quantity on our approved B.O.Q. even though our contract is “remeasurable”. Like for example the screed we have only 435 M2 on the B.O.Q. when in fact we have a building area of 2000 M2 for each floor. Therefore, we will be having approximate quantity including roof of more than 4000 M2. Same also with concrete and other items especially on mechanical discipline we are exceeding the mentioned quantity on our B.O.Q.
If we have an established system of collection it will be very easy to prepare the evaluation because all quantities are prepared in advance, it is only placing the summary with corresponding percentage on the evaluation sheet, then its finished.
So may I propose to prepare our own B.O.Q base on our approved drawings, and submit it as a whole variation order after approval of all pending materials especially on mechanical discipline?
I prepare a list of cost breakdown for discussion and are all in the possession of Engr. Hasan.

Calculation of Structural Design of Renovated Area,
Dear Sir,
We received our drawing submittal BAW-ONC-RFA-S-198 Release on July 20, 2008, for Renovated Area with comments that you are asking us to submit the structural design of this area.
We would like to remind you again that is not our responsibility to prepare the structural design calculation it is the sole responsibility of the client to give us the contract drawing, which had been designed by an individual consultancy firm or by the owner.
When we received the contract drawing, we prepare detailed working drawing to be used on site, for easier understanding to us and to the PMD. And to use this drawing to measure all quantities.
As for this area, the design was not changed but it is only moved from inside the main hospital to outside of the hospital along the road,
We will re-submit this drawing for your review and approval.

Request for Time Extension
It is our both acknowledge that work progress of the above mention project is badly in effective with major factors obstructing our both intension to complete and operate New Oncology Ward Phase 1, in the contractual date. These factors could be summarized by the following:
1.
LINK BRIDGE
In reference to your letter (ES/PMD/4132/06/08) we received your notice to proceed with the construction works for the Link Bridge and the Renovated Area at the Main Hospital on June 14, 2008, and soon we start manual excavation and relocation of the underground utilities, But the affected offices are only recently vacated, and we are only starting on the process to take all the necessary permit from Work Control of the Main Hospital to start the sealing of the area prior to start demolition on the affected offices, they only release the permit to work for Electrical Discipline, we have still to secured Mechanical, Fire and Infection Control before we can start the demolition work and excavation,
Consequently, this delay in releasing this area will affect the related activity

UNDERGROUND UTILITIES
As we did not receive any information regarding the resources and Tie in Points for the underground utilities, we cannot proceed with the site work related to the following:

Sewage Lines

Storm Drain
2.3
Domestic Water
2.4
Electric Power
Consequently, Testing and Commissioning for all system related to the above-mentioned utilities Can’t be proceed later on

APPROVAL of VARIATION ORDER,
In order to proceed with the Variation Order, we are still waiting for financial approval for the followings:

Lox Tank

Telephone System
3.3
HEPA Filters
4.
MISCELLANOUS

Bed head unit information up to know we cannot start closing the gypsum walls because the medical gas cannot start due to not available technical information(see attached Memo)

Air handling unit approval takes more than a year.
5.
SERVICE BUILDING
-Your request to combined the two Service Building for Oncology Phase 1 and Phase 2 during our weekly coordination on site had been submitted for approval and approved on February 10, 2007
- Shop drawing and materials submittal had been completed and approved.
- Based on the above mentioned approval, we took a prompt procurement action especially for the long lead items to secure the delivery with in contract time, which mainly consist of the following:
- Generator Sets
- Automatic Transfer Switch
- Chillers
- Fire Fighting Pumps
- Transformer
- Cables
- Chilled Water Pipes
- Fire Fighting Pipes
5.1
In addition, Civil and Structural Works commence on site.
The above mentioned activity has been obstructed by your letter
(ES/PMD/4258/08/08) dated August 10, 2008 due to conflict possibility with other incoming projects. Holding the activities of the Service Building will affect the progress on site due to the following:

Hold on the Construction Works

Equipment can’t be installed
-
Routing of the Utilities to serve the main building could be change, consequently the the sizes of cables and pipes could be change also
-
Testing and commissioning for the system resourced by the service building can’t be performed
-
Location of the Lox Tank will be also change as per your letter (ES/PMD/4270/08/2008) dated August 17, 2008
In conclusion of the above, we propose to join the completion date of Oncology Phase 1 and Phase 2 on JULY 15, 2009 (Finished date of Phase 2 by contract July 15, 2009).
THE ITEM 4 REQUIREMENT OF ADDITIONAL WORKS ARE ALREADY CANCELED BY PMD AS PER RELEASE SUBMITAL (MAIN FEEDER LINE AND STAND BY TRANSFORMER) as for the changing power to Nurse Call system it is our mistake that we ordered 110 V instead of 220 V.
ENGR. Dear Sir,
Reference to the above mentioned subject, we would like to have a coordination meeting with Saudi Bin Laden to avoid clashing of activities between us, especially around the Service Building when we have to start our external works, or is it enough to inform PMD in advance when ever we have to start any excavation affecting their job?
We have to excavate our buried services like electrical duct banks, chilled water pipes, fire fighting pipes, irrigation water pipes, sewage pipes, gray water pipes, potable water pipes, medical gas pipes and medium voltage cables, in which all has to be crossing the main road on their projects.
Above mentioned underground services has to be finalized prior to start asphalting of the main road.
Further more there are existing medium voltage cables, which cross the road and our Service Building.

Subject: Oncology Phase 1 & Phase 2 Time Extension,
It is both our understanding that in spite of the big effort we put together to solve the technical and execution matter on site in order to maintain a smooth progress for our Oncology projects Phase 1 and Phase 2 in compliance with your high standard of specifications and quality with in the contractual time frame but major obstruction pertained by site conditions and beyond our both control has been jeopardized the work progress and badly affect the completion sequence of the work due to the extreme additional time required to start and complete certain condition on the critical path of the project schedule which could be summarized as follows:
1.
LINK BRIDGE AND RENOVATED AREA
We submit our construction planning for approval and review and as per our first submittal we have the intention to start the Renovated Area on January 20, 2007. So we start asking PMD to check for us when the concerned occupants at the main hospital can be relocated. We send also a letter (Ref. BAW-ONC-0840 dated March 24, 2007, with attached revised construction planning intended to start on June 7, 2007. We had attended so many meetings with all concerned departments with in main hospital together with PMD, and we explain to them how we have to construct this Renovated Area and what kind of activities each department had to do, we explain to each department the clashing of each discipline.
The submitted drawing for renovated Area was approved on May 14, 2007
After so many follow up there is any inch of movement to this area. Everything we discussed to all individual supervisors with in the main hospital, nothing has been done in spite the concerned supervisors coordinated with us for all work to be done.
We propose a new location for this link between the Main hospital and the Oncology Building, and the proposal after so many discussion and review had been approved.
The first thing we had to do prior to start construction is to relocate the existing drainage system which is crossing the building. So we excavate the area and start construction of the new manholes required for relocation, when we try to lay the sewer pipes connecting the manholes we don’t have any problem but when we excavate the manholes where we have to do the tie in, there is a strong seepage coming from the existing manholes, we open the manholes and we found out that there is overflowing of sewage waste, because the pumps at the lifting station are not working.
It takes almost a month before we finally connect the new route of drainage system, due to this overflowing. After connecting all manholes to the rerouted drainage system, we started our excavation for the raft foundation.
We can only start our construction at the Renovated Area after securing all required working permit from Utilities & Maintenance Division main hospital for all work discipline. We finally secure all working permit by September 10, 2008.
So the actual start of construction to this area start on September 10, 2008.
As for the steel bridge the drawing was approved on May 30, 2007, and the fabrication has been completed in compliance with all approved shop drawings and delivered to site on March 16, 2008
2.
SERVICE BUILDING
2.1
Shop drawing for Service Building related to Oncology Phase 1 has been submitted and approved on June 18, 2007 (ref. submittal ONC-RFA-184-A)
2.2
In compliance with PMD instruction as follows to:
-
Combined the Service Building of Oncology Phase 1 and Phase 2 in one Utility Building.
-
Revised layout of electrical and mechanical equipment rooms
-
Enlarge the capacity of the fire fighting water tanks.
-
Additional tank for potable water
-
To coordinate deeply with adjacent project to finalize the location of the Service Building to avoid clashing with the new KAMC Project.
2.3 Taking in consideration the above mentioned requirement the contractor submit a new proposal for all engineering aspects for PMD approval.
2.4 To coordinate with Saudi Bin Laden Co. and to Dar Al Handasah with the presence of PMD for the underground services which servicing the Oncology Phase 1 & Phase2. In which we submit all approved drawing for Dar Handasah review prior to start external works with in the Service Building. We don’t received any approval or comments up to now, so we cannot start execution of activities as per the approved external coordination drawing.which was approved on March 28, 2009.
3.
UNDERGROUND UTILITIES
3.1
Service Trench
- Due to major changes in design criteria , structural skeleton layout of electrical and mechanical equipment and the location of the Service Building , the related service trench
Hanging the underground utility network servicing the Oncology was on hold accordingly.
-
Construction work for the service trench on the link between two Oncology was done and then we are advice to stop the execution because it is not approved financially from N.G.H.A. in Riyadh.
3.2
Sewage System
- Our contract was limited to construction of external around the oncology building and connecting the sewage line from building to manholes only
- Engineering work for the external sewage system could not be preceded due to the lack of information as follows:
a. Location of tie in points to the existing KAMC utilities, to determine the slope direction and required level, to work the system.
b. Type of sewage storage tank.
c. treatment system
- Several letters for tie in points are issued to PMD on September 19, 2006 (ref Letter BAW-ONC-031, December 3, 2006 (ref letter BAW-ONC-052-A
-Upon receiving final confirmation to this Sewage System we could estimate the time required to execute and complete the Sewage System.
4.
POWER SUPPLY
-
Location and type of tie in point for the Medium Voltage cable still not determined by PMD.
5.
POTABLE WATER AND GRAY WATER
-
Our scope of work for these two systems is up to the valve box and check valve outside the building which is located along grid line 3, the connection to tie in point is not included to our scope of works. as per request from PMD the following has to be done:
a.
Potable water supply to Oncology Building will be incorporated to the Service Building and additional pumps and pipes are to be installed, and as per latest verbal instruction from PMD Engineer additional treatment for potable water has to be installed.
b.
Gray water supply to Oncology Building will be incorporated to the Service Building and additional pumps and pipes are to be installed.
6.
BED HEAD UNITS
-
In order to complete the first fix and second fix for the electro/mechanical works related to the Bed Head Units we request for complete technical information about the Bed Head Units since November 5, 2007. (Ref. letter BAW-ONC-156)
-
Physical sample arrived on site and submitted for approval to the end user on February 9, 2009, and after approval that’s the time we continue for the fixing of medical gas system and electrical works connected to the Bed Head Units.
-
Therefore, the closing of the Gypsum Wall Partitions starting with the finishing works had been delay more than 10 Months.
7.
TELEVISION BRACKETS
I- We cannot start closing the suspended ceiling to the patients room unless the type and location of the television bracket are solved.
8.
TESTING AND COMMISSIONING
- In the absent of main resource equipments to supply the site with running water , energized power and sewage system , testing and commissioning work for the following cannot proceed;
a. HVACs System (Balancing)
b. Lighting and Power
c. Chilled Water System

The Oncology projects had suffer so many changes and difficulties even before I joined N.G.H.A. even though all problem occur on this projects and change of management from our side, still the Al Bawani Management & staff , maintain a good relations to us and deal with us professionally in all aspects. Even in dealing with Dar Al Handasah to coordinate all external works in relation to other projects, your team is doing it right.
We want to express our satisfaction to your staff on site because in spite all the difficulties and problem they encounter in day to day, still they hold on their attitude.
Before you have one Architect on site but he is not capable to do his job and your Project Manager always do the dealing and even design of drawings as per discussed with us.
Mr. Jay-Jay Lagman who was introduced to us as an AutoCAD operator upon his arrival on this project, took over the responsibility of your Architect who left the site, He is preparing all drawing as per discussed with us and in closed coordination to all works discipline which is top priority for all architectural works. He is dealing with us with proper courtesy and in a very professional way. Aside from this responsibility he is also supervising all architectural works on site.
Engr. Larry Nartea is a very professional and he knows his trade very well, and he works in close coordination with our Electrical Engineer.
Engr. Jordan Lagman who starts this project from the start is very capable to do all his job assigns to him. He is a multi task engineer on site, he works as the Site Engineer, Safety officer in which he even attend seminar conducted with in the KAMC. Aside from that he is also assign as Q.S. Engineer on site. He is preparing the quantities for Civil & Architectural works in a very professional way.
Engr. Fuad Al Massry, who just joint the team lately, know is trade well and he is depending changes from site with all calculation to show to us that the changes is done for the benefit of the projects.
In spite he inherited all the problem for mechanical works, slowly he is closing item by item. But due to too much workload on mechanical works sometimes he is missing the deadlines for submitting submittal which had been agreed upon.

As we discussed last night that I am fully responsible for the management of Oncology project here in Jeddah, I say thank you for giving your trust in me. I am opening myself for any investigation of all my action in the future just to show that I will govern the Projects with full transparency and accountability to the company.
In return all I ask is your full support to me, we will coordinate in H.O.R. for any support we need on the projects, I will be reporting to you personally but if I need any assistance or advice regarding project matter I will coordinate with the two gentlemen who are cc; to this letter.
Engr. Yahya Al Ersali is no need to come on site all I want from him to is to follow up any remaining materials, equipment drawings from supplier who are based in Riyadh and in parallel we will also check some local supplier here in Jeddah and all we had to do is to make a cost comparison and check technically if everything is with in the specified norms.
We will consult you and seek your approval of some materials or equipment, which is exceeding above our cost price.
We will also needing additional staff to run this project smoothly; I will send the list by other letter.
AS I OBSERVE THERE IS ONGOING IN-FIGHTING TO SOME STAFF WITH IN THE COMPANY AND THIS HAS TO BE STOP, IF THERE IS A LOT OF FRICTION WITH IN THE STAFF, THE COMPANY BECOME THE LOSER.

Project Rules,
As per our meeting today once again I would like to inform everybody that all Engineers has to
be on site as per approved working hours. Everybody is on call basis from the consultant starting from 08:00 hrs. to 17:00 hrs as per their working hours.
If you cannot arrive on time, you have to call or inform the undersigned the reason of your delay.
Every Engineer is responsible to all equipment or materials to be on site when ever required. It means you have to initiate the gathering of technical submittals from supplier up to final approval and ordering the material or equipment as per site requirements, this is in coordination with Mr. Walled Tujjar who will assist all Engineers as per their requirement.
Any financial matter regarding materials or equipment will be dealt by the under signed in coordination to Higher management in H.O.R.
If any suppliers are based in Riyadh or out of Jeddah we have to coordinate at H.O.R thru Engr. Yahya Al Ersali.
Every Engineer is responsible for checking and preparation of shop drawing including as built drawing for approval, including quantifying of all items which has to be included to the evaluation for approval.
There should no interfering to other Engineers scope of work but rather it has to be coordination to avoid clashing of activities. We have to respect each work on site to avoid damaging any installed items on site and repetitions of work to save time and money..
The following task is delegated to each staff:
Engr. Ameen Taktok will head the Electro – Mechanical Section, under him Engr. Larry Nartea for all electrical discipline and Engr. Fuad Al Massry for all Mechanical Discipline.
Engr. Jordan E. Lagman will be in charge to all remaining works of Civil, Structural & Architectural works related to office works and under him will be Mr. Jay Jay E. Lagman
Mr. Jay Jay E. Lagman will be in charge to all site activities for Civil, Structural & Architectural works under him will be Castro and two more foreman which we will try to take from other site, he will coordinate with Mr. Walled Tujjar for subcontractor works and to ease the communication barrier.
Mr. Walled Tujjar will be in charge to finalize all remaining material and equipment in coordination to Lead Engineers, he has to gather all technical submittal from local supplier here in Jeddah, This action is priority to make sure that all missing equipment or materials will be on site when ever we required.
He will act as coordinator to all local subcontractor on site and at the same time he will be in charge to all procurement of local materials, the driver are with in his disposal to buy or collect materials . Aside from that he will act as personnel administrator to check all labors are house properly and looking for their well being.
It is not allowed to discuss other matter to the consultant which is not related to your scope of works. All subject to be course thru the undersigned before discussion to the consultant, this is to make sure all subjects we agreed are with in the parameters of our contractual obligation to the client.
All Engineers has to prepare an advance weekly activity report with target date of completion for any item, which they are intending to do by themselves including the crew who are working under his supervision,
This report has to be submitted every Saturday to the under signed for further checking, further more this activity report will be extended to one month in the future.
We will be conducting meeting on Saturday, Monday & Wednesday every week at 09:00hrs sharp.
I expect that everybody will do their utmost for the success completion of our projects.

Reference to the above mentioned subject, we would like highlight some important points:
As per our internal meeting May 7, 2009 and as discussed with all concerned Engineer and the project management -Jeddah, We are instructed by the Project Manager to finalize this evaluation the soonest for we are in financial difficulties. We agree to finalize the quantity for review as soon as possible because we want our work to be evaluated.
I prepared & submit to you the quantity of metal duct measurement of ground floor including the fire fighting pipes quantity on May 9, 2009 as per site condition of approved shop drawing including all attached document, for your action and further discussion and approval to PMD.
I give this document to you for respect being my superior and as par as I know you will be the one to discuss all quantities to PMD being the Head of Mechanical discipline.
My submittal for mechanical discipline are not release up to now, I want to received the submittal as soon as possible approved or disapproved so I can take necessary action what ever is required.
And by next time kindly talk to me personally and if I have to sign for any instruction you give to me I will do, instead of issuing me a letter in which I’m only a few meters away from you.

Reference to above mentioned subject, herewith we submit the variation order and additional works for Oncology Phase 1 and Phase 2, including some items which supply or applicable to both buildings.
There are only 3 variation items (Lox Tank, Hepa Filters & Telephone System) approved from PMD-Jeddah,
The additional items Medical Gas Pipe main line and the Decorative Ceramic Tiles are approved by PMD -Jeddah.
The other remaining additional works are submitted for approval to PMD and are still under review.
The old substation cost was included to the third summary which services the both buildings.
Attached are three summary and the cost are as follows:

Termination of Works @ Oncology Projects,
This will serve as a notice of termination of your services on Oncology Projects; your last working day will be as of today June 1, 2009.
You are instructed to hand over any company properties prior to leave the site, including company documents. I would like to take this opportunity to say thank you for the short stint you stay on the projects,
Since you start I clearly explain to you what to do & where to go and I had given you a full authority for Electro/Mechanical Works. I let you run your task as you can during the first weeks but when I see that the results are not satisfactory.
Then I come to assist you by giving you the list of activities what need action from your side. but to no avail the outcome is not good enough. Sad to say you fail my expectation being head of department.
Base on the above and because of your personal attitude to other. Your service is terminated due to insubordination to your superior.
We cannot steer the ship with two captains otherwise it will sink.

Subject: Decorative Band of Ceramic Tiles,
Dear Sir,
In reference to our approved material submittal (ONJC-RFA-10F dated July 14, 2008 for the above-mentioned subject
We would like to highlight that this decorative band was not included on the B.O.Q. and to contract drawing.
In this regard we would like to charge the Decorative Band Tiles to the item I Skirting Coved as mentioned on the B.O.Q. of Oncology Phase 1 & Phase 2 or we can charge the decorative tiles to item G Threads (as drwg. A013, Detail 2) & item H Risers (as drwg. A013, Detail 2) which are intended to be use for the stairs but are cancel by the previous Architect (Shada) of PMD.
Attached are part of the B.O.Q. FOR PHASE 1 & Phase 2
